    Post: Expelled Student Returns- HELP!!!!!
    Posted by: Katie/CA on 11/04/09

QUESTION: CAN A STUDENT THAT WAS EXPELLED(FOR BRINGING A GUN
TO SCHOOL) RETURN TO THAT SCHOOL THE NEXT SCHOOL
YEAR????????? Read on for the full story.....

Last year a 4th grade student was placed at our school from
another one in our district. He hit an aide and was expelled
from school. He was then assigned to our school. A couple
months later he brought a BB gun to class and showed it to a
few students. Thank goodness one student told her mom and it
was immediately reported. He was expelled from our school
    then too.
Well, last Friday we were notified that he would be
returning to our school. Needless to say, the parent of the
child who told on him, is very worried and upset. Now today
another parent in the class emailed the teacher to find out
if the "rumors" were true.(The teacher forwarded the email
    to the superintendent)
On his first day at our school, the expelled student
confronted the student who reported the gun situation and
asked if he was the one who told on him. (Now the poor kid
is really scared) To make matters worse the expelled
student's brother (who was placed in my class)told him he
was going to beat him up.
The worried parent called the district office and was
told by the superintendent that Ca law only allows you to
expel a student for one school year and that we HAVE to take
    him back.
Have any of you been in this situation? Even his
teacher is afraid of him and afraid to confront him on
anything for fear that he will do something to her. What
rights do we have for our student's safety and our own??? Do
we just wait and see if he explodes?
Thanks for any suggestions you have.
