The school district probably does have to take him, but that
doesn't mean your school has to. If he came to you from another
school, he can also be sent to another school. We call this
opportunity transfer here in LA. It is just a way to pass on the
problem, but with a lack of resources, and the law protecting the
child, there is often little choice.

It sounds to me like it will take the parent of the harassed child
to get a lawyer and threaten to sue the district to get the
harassing child out of the school. It is a terrible situation for
you, but one that we in public schools deal with often. Best wishes,
